The cassation supported the FAS in cases of anti-competitive agreements at auctions for the transportation of MSW worth 7.7 billion rubles. This is stated in the message of the service.
Clean City LLC and Ecosystem Company LLC entered into an anti-competitive agreement, which led to limited competition at auctions in the Kurgan region.
LLC "Ecosystem Company", LLC "Transservice", LLC "Turaservice-N", LLC "Ecotrans" and LLC "PTK" have concluded and implemented a competition-limiting agreement. It led to the maintenance of prices at auctions for the provision of services for the transportation of MSW in 5 regions: Sverdlovsk, Kurgan, Tyumen, Murmansk regions and Khanty-Mansiysk Autonomous Okrug – Yugra.
The FAS recognized the organizations as violating the antimonopoly legislation. For the conclusion and implementation of two anti-competitive agreements, the companies were fined in the total amount of 325.4 million rubles.
The organizations tried to challenge the decisions and resolutions of the service. The courts of three instances supported the position of the FAS.
