The Moscow Federal Antimonopoly Service of Russia received a complaint about the actions of JSC "FPC" during the procurement for the maintenance of fire protection systems at FPC facilities. This is stated in the message of the service.
According to the arguments of the complaint, the applicant disputes the refusal to admit the application during the procurement procedure on the basis of providing false information about the available staff.
The customer did not agree with the arguments of the complaint, explaining that he acted in strict accordance with the provisions of the procurement documentation. The customer's employees came home to the participant's employee, who was on sick leave, to take written explanations on the issue of employment in the company.
The Commission concluded that written explanations of an employee who is in an unsatisfactory state of health, actually under pressure, cannot be used as a basis for making a decision on the unreliability of the information provided by the participants, since the documentation does not provide for on-site inspections of the participant's employees, but only provides for the possibility to request information from state and other institutions, legal entities and individuals necessary to confirm the accuracy of the information.
The Moscow Federal Antimonopoly Service of Russia recognized the complaint against the actions of JSC "Russian Railways" during the procurement as justified, having established violations of paragraphs 1, 2 of part 1 of Article 3, part 14 of Article 3.2 of the law "on procurement", a mandatory order for the review of applications was issued.
Disagreeing with the position of the Moscow UFAS of Russia, the FPC appealed the decision of the Department in court. However, the Arbitration Court of the City of Moscow supported the position of the Moscow Federal Antimonopoly Service of Russia, the FPC's claims were denied.
