Certification has been simplified for patent attorneys of new territories

The Federation Council approved the law on certification of residents of new Territories as patent attorneys. The initiative was developed by the Ministry of Economic Development of Russia. The document provides for a simplified procedure for the return to the profession of those who worked in this field at the time of the regions' admission to Russia.

"To become a patent attorney, you need to be certified by Rospatent. It provides proof of at least two years of experience in providing services for the protection of intellectual property rights. It is also necessary to take an exam and confirm your knowledge of the law. After that, Rospatent decides whether or not to include the candidate in the register of patent attorneys," commented the Deputy Minister of Economic Development of Russia Maksim Kolesnikov.

According to him, residents of the new regions who have received Russian citizenship will be included in the register in a simplified manner — only based on the results of passing a free exam. The candidates' work experience will be confirmed by the presence of a previously issued Ukrainian certificate of an intellectual property representative.

The new regions show good dynamics of registration activity. In 2023, applicants filed 41 applications for inventions and 343 for trademarks.

"Residents of the new regions will be able to obtain the status of a patent attorney and start working this summer," he stressed Maksim Kolesnikov.

The simplified procedure will be in effect until January 1, 2026. The draft law has been prepared within the framework of the "Transformation of the business Climate" mechanism. It is included in the roadmap following the meeting of the Council on Intellectual Property Issues under the Chairman of the Federation Council of the Federal Assembly of the Russian Federation.
