Recall that as part of the control over legal regulation, the Federal Forestry Agency conducts an examination of legal acts of regional forest departments. So, when checking the order, the agency revealed violations of the law.
The regional department has agreed to lease a forest plot for the operation of a real estate object on it. At the same time, by virtue of the Law on Forest Amnesty, if a real estate object is located on the lands of the forest fund, the purpose of which is not related to the use of forests, the rights to which arose before 2016 and were registered in the EGRN, then the Federal Property Management Agency agrees on the lease of such a site.
"Checking the regional order, we found a violation of forest and land legislation. Under real estate from the forest fund, you can form a plot with a different category corresponding to the purpose of the property. But then it is no longer the regional forestry departments that are authorized to provide and pre–approve the provision of the site, but the Federal Property Management Agency, since the category of the site will change, and the former owner is the Russian Federation," concluded Elena Borodavkina, head of the legal Department and use of forests of the Federal Forestry Agency.
She also added that the regional forestry department needs to correct the sectoral document in accordance with the current forest and land legislation.
