The Central Bank challenged the Luxembourg court on the indefinite freezing of its assets

The Bank of Russia has filed an application to the General Court of the European Union (Luxembourg) challenging the Regulation of the Council of the European Union dated December 12, 2025, No. 2025/2600. This is stated in the press service of the Central Bank.

The Russian regulator emphasizes that as a result of the adoption of the EU Regulation, the basic and inalienable rights to access justice, inviolability of property, and the principle of sovereign immunity of states and their central banks, guaranteed by international treaties and EU law, were violated, which contradicts the fundamental principles of law and cannot be recognized as compatible with the rule of law.

In addition, significant procedural violations were committed during the adoption of the contested EU Regulation, in particular, since it was adopted not by unanimity of EU members, but by a majority vote, bypassing the requirements of article 215 of the Treaty on the Functioning of the European Union, the report says.

The contested EU Regulation imposed an indefinite freeze on the assets of the Bank of Russia. The possibility of judicial protection of violated rights to assets is also excluded, including through the enforcement of any court decisions in connection with the measures taken by this act.
