The Ministry of Justice has prepared draft amendments to the Criminal Procedure Code of the Russian Federation, which provides for a ban on detention for committing crimes of small and medium gravity in the field of entrepreneurial and other economic activities, except in cases when the previously chosen preventive measure was not observed, or the violator tried to hide from the preliminary investigation bodies or from the court. This is reported by the Ministry.
The bill also clarifies the grounds for choosing a preventive measure in the form of detention in relation to business entities and members of management bodies of commercial organizations, taking into account the severity of the incriminated act.
The priority of the application by the court of another preventive measure against the specified category of persons, allowing them to continue their entrepreneurial activity, is established.
In addition, it is planned to reduce the maximum period of preliminary investigation in this category of cases from 12 to 6 months.
The draft law establishes the need for the investigator to obtain the consent of the prosecutor to initiate a petition before the court for the election of a preventive measure in the form of detention against persons suspected or accused of committing crimes in the field of entrepreneurial and other economic activities.
