The State Duma adopted a law on microdoles in apartments

The State Duma adopted in the second and third readings amendments to the Family Code and a number of legislative acts aimed at combating microdoles in apartments. This is stated in the message of the lower house of parliament.

The law establishes the minimum possible limits for the fragmentation of shares in the ownership right. In terms of meters, according to the amendments to the Housing Code, the share cannot be less than 6 sq. m. m of total area for each co-owner.

At the same time, amendments are being made to the Family Code. They grant the court the right to change the ratio of the spouses' shares in their common property (not only in housing) in the event that one of them made transactions for the sale of common property on unfavorable terms without the consent of the other required by law.

For example, during the divorce process, it turns out that one of the spouses sold the apartment without the consent of the second. In this case, there will be no need to recognize the transaction invalid in court. It will be enough to prove that the transaction was made without his consent. In this case, the court may reduce the share of the common property of the unscrupulous seller, and increase the share of the injured spouse.
