The Twelfth Arbitration Court of Appeal upheld the claims of the Nizhny Volga Interregional Directorate of Rosprirodnadzor for compensation for damage caused to soils in the amount of 22.9 million rubles. This is stated in the message of Rosprirodnadzor.
The violation was revealed during a joint inspection with the prosecutor's office. During the construction of a well in the Astrakhan region, an uncontrolled release of a water-gas-clay-sand mixture occurred, which led to contamination of the land.
Specialists from the accredited laboratory of the Central Research Institute took soil samples and confirmed the excess of pollutants. The total area of pollution was almost 8.8 thousand square meters. m. During the inspection, Rosprirodnadzor identified the individual entrepreneur who carried out the work on the construction of the well and calculated the amount of damage caused to the soils.
The demand for voluntary compensation for damages remained unenforceable. After that, Rosprirodnadzor appealed to the court.
The court of first instance dismissed the claim, but the agency appealed the decision. The Court of Appeal supported the position of Rosprirodnadzor and ordered the entrepreneur to compensate the damage caused to the soils in full.
